Description
Some tours are required to complete a Section 40E Permit https://www.dmp.wa.gov.au/Minerals/Permit-Section-40E-over-granted-2421.aspx and sign tour agreement/terms and conditions.
Tours are for a maximum of 10 people.

Cancellation Policy
The Terms and Conditions under which Pirates Gold Prospecting Tours operate are detailed below. Payment of the Tour deposit represents an acceptance of the Terms and Conditions. BOOKINGS & DEPOSITS The deposit of 25% is payable to confirm a reservation .To confirm a tour booking the deposit must be paid at the time of making the reservation by direct bank deposit. AT TIME OF BOOKING Clients are asked to notify of any special requirements (for example health or special needs) at the time the booking is made. FINAL PAYMENTS The final payment for your booking must be received in our office no later than 60 days prior to your tour date. This payment date will be clearly spelt out on your booking confirmations. For bookings made within 60 days of the tour departure the full tour payment will be required within 7 days. CANCELLATIONS Cancellation fees will be levied relative to the amount of notice given and must be received in writing or by email. Please refer to the tables below: Days of notice required for cancellation: 180 or more is 50% loss 100 – 179 is 50% loss 60 – 99 is 50% Less than 60 days is 100% loss In the event of sickness from COVID 19 or any other pandemic virus we will offer you a transfer to a later tour or transfer to the following year. DATE CHANGES Changing to another tour departure for the same tour is permitted if there is sufficient availability and the new date falls within 60 days of the old departure date and is within the same calendar year. Requests must be made at least 60 days prior to the tour. If an alternate date is unavailable or unsuitable and you cannot attend the tour on the original date your booking will be subject to our standard cancellation terms detailed above. Change requests within 60 days of departure will be treated on a case by case basis and may incur a change fee. TOUR FARES The tour fares quoted in this brochure are per person The tour fares quoted are in Australian Dollars (A$) and include Australian Goods and Services Tax (GST). TOUR INSURANCE Pirates Prospecting Tours strongly advises passengers to take out travel insurance to cover any unforeseen circumstances leading to cancellation. ITINERARY AND TOUR ARRANGEMENTS Clients accept that Pirates Prospecting Tours may need to alter or amend itineraries or sightseeing arrangements from those published with little or no notice. This may be due to road conditions weather safety factors and other operational considerations at the time. Such decisions will be made in the best interests of the clients’ comfort and safety. In the West Australian goldfields roads can occasionally be closed temporarily due to heavy rain station activities ceremony and other cultural considerations. In these circumstances Pirates Prospecting tours will endeavour to make suitable alternative arrangements. RESPONSIBILITY & LIABILITY Pirates Prospecting tours accepts no responsibility or liability for any injury loss damage change of itinerary or inconvenience caused either directly or indirectly as a result of force majeure or other events which are outside of our control including but not limited to: fires floods acts of God unusually severe weather industrial action. Pirates Prospecting tours endeavor to locate gold bearing areas but cannot guarantee gold finds. HEALTH & FITNESS Most of our tour itineraries contain guided Gold Prospecting tours Clients are required to have a reasonable level of fitness in order to participate. Some prospecting areas have sections of uneven rocky ground and may be slippery. Whilst on a tour it is the responsibility of each passenger to carry adequate drinking water. GPS EPIRB and handheld UHF radio. RISKS PARTICIPATION & ENJOYMENT •Clients accept that tours include participation in activities which may involve certain risks and dangers beyond the control of Pirates Prospecting tours such activities containing risks include but are not limited to bush walking and travelling in remote undeveloped locations. •Passengers accept that itineraries include visits to and overnight stays in remote areas located some distance from hospitals medical centres or other forms of professional medical facilities. •Passengers accept that it is their responsibility to ensure that their health is in a state which will allow them to enjoy the tour and successfully complete the activities that the tour offers. •Passengers will not be permitted to continue on tours when in the opinion of the Pirates Prospecting Tour Leader the passenger’s conduct or condition is placing their own or the safety of other passengers at risk or is adversely affecting the enjoyment of other clients; for whatever cause. •Pirates Prospecting tours will take all reasonable steps to provide an enjoyable tour. However no liability will be accepted for any loss of enjoyment experienced by passengers due to circumstances which are out of our control. •PIRATES PROSPECTING TOURS Strongly recommend all clients become members of APLA (Amalgamated Prospectors and Lease Holders Association) www.apla.com.au DISPUTE RESOLUTION Should any dispute arise between Pirates Prospecting tours and a client it is agreed that formal proceedings in a Court or Tribunal will not commence until after the following process has been complied with: A written notice specifying the nature of the dispute (“the notice”). Following the issue of the notice the parties will in good faith attempt to resolve the dispute by negotiation mediation expert determination or as otherwise agreed. If the process for the resolution of the dispute is not agreed with within 7 days of the receipt of the notice the parties must mediate the dispute. Mediation will be conducted in accordance with Rules and Regulations of the West Australian Law Society as at the date of the dispute. If the parties cannot agree the Mediator will be appointed by the President of the Law Society of West Australia or nominee. If there is no resolution to the dispute at the expiration of 30 days from the receipt of the notice formal proceedings may be commenced. The laws applicable in West Australian government these Terms and Conditions and the parties submit to the jurisdiction of the Courts and/or Tribunals of West Australia to herein determine any disputes between the parties.
